Permissible and Impermissible Acts During the Fast – Part One Featured

1. It is permissible for one who is fasting to sleep next to his wife, to touch her or kiss her on her cheek. However, if one fears that these acts will lead to intercourse, then he should abstain from this. In such a case, it will be makrooh for one to do such acts. [1]

2. In the state of fasting, one should refrain from kissing one’s wife on the mouth (lips), as there is fear that the saliva may enter the mouth and be swallowed. If one had kissed his wife on the mouth and her saliva entered his mouth and was swallowed, his fast will break and qadha as well as kaffaarah will be waajib. Similarly, if his saliva entered her throat and was swallowed, her fast will also break and qadha and kaffaarah will be waajib upon her. [2]


[1] ولا بأس بالقبلة إذا أمن الإنزال والجماع لما روينا ولما روي عن عائشة رضي الله عنها أنه عليه الصلاة والسلام كان يقبل ويباشر وهو صائم رواه البخاري ومسلم وعن أم سلمة أنه عليه الصلاة والسلام كان يقبلها وهو صائم متفق عليه ويكره إن لم يأمن لأن عينه ليس بفطر وربما يصير فطرا بعاقبته فإن أمن اعتبر عينه فأبيح وإن لم يأمن يعتبر عاقبته فيكره (تبيين الحقائق 1/324)

[2] كذا إذا ابتلع بزاق غيره لأن هذا مما يعاف منه حتى لو ابتلع لعاب حبيبه أو صديقه ذكر الشيخ الإمام الزاهد شمس الأئمة الحلواني أن عليه القضاء والكفارة لأن الحبيب لا يعاف ريق حبيبه أو صديقه (بدائع الصنائع 2/99)
